Shop Talk with Ken

Terms & Conditions

SUMMARY

We will always do our best to fulfill your needs and meet your goals; however, sometimes it is best to have a few simple things written down so we both know what is what, who should do what, and what happens if something goes wrong. In this contract you will not find complicated legal terms or large passages of unreadable text. We have no desire to trick you into signing an agreement you might later regret. We do want what’s best for both parties, now and in the future.

NOTE:  These first sections will contain language applicable to all Shop Talk with Ken products and services.  Below that, please find the section applicable to the product(s) and/or service(s) you wish to purchase from us.

WHAT DO BOTH PARTIES AGREE TO DO?

As our customer, you have the power, and ability, to enter into this contract on behalf of yourself, your company, or your organization.

You agree to provide us with everything that we need to complete your level of viewer support including name, email, phone, and address if necessary to send you products applicable to your level of support. You also agree to stick to the payment schedule set out in the product/service package you purchase.

We have the experience and ability to perform the services you need, and we will carry them out in a professional and timely manner. Along the way we will endeavor to meet all deadlines; however, we are not responsible for a missed deadline if you have been late in supplying information. In addition, we will also maintain the confidentiality of any information you provide us.

LEGAL STUFF

We are not able to guarantee the functions contained in any of our products to be always be completely error-free, and therefore you agree we will not be held liable to you, or any third party, for damages, including lost profits, lost savings or other incidental, consequential, or special damages arising out of the operation of or inability to use or operate our completed products or services, even if you have advised us of the possibilities of such damages.

If any provision of this agreement is determined to be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from this agreement and shall not affect the validity and enforceability of any remaining provisions.

PAYMENTS

We are sure you understand how important it is for you to pay the invoices we send you in a prompt and timely manner. We are also sure you will want to stay friends, and you therefore agree to stick tight to the payment schedule described within the product or service you wish to purchase.

CANCELLATIONS

You may cancel your support at any time for any reason – we will still love you.

REFUNDS

We do not offer refunds for any product or service.  Any fees paid to Ken Collins Marketing (via Shop Talk with Ken) are non-refundable.  You may cancel at any time, but no pro-rated refund will be offered.

If we have incorrectly charged you for a product or service you did not request, and we are notified prior to providing those products or services, we will promptly refund your money in full.

SMALL PRINT

But where is all the horrible small print?  Although the language is simple, the intentions of this document are serious. Just like a parking ticket, you cannot transfer this contract to anyone else without our permission. This contract stays in place and need not be renewed. If for some reason one part of this contract becomes invalid or unenforceable, the remaining parts of it shall remain in place.

LIKE IT

IN SHORT

You are paying Ken Collins Marketing (via Shop Talk with Ken) $1 every month to add your name to the list of supporters on our Shop Talk with Ken website.  In some cases, this can happen within a day.  In some cases, your name will appear on the site within a week.  Regardless, we appreciate your support and will get your name on the site as soon as we possibly can.  If you should decide to cancel your support, we will remove your name from the site as soon as we possibly can.

 

LOVE IT

IN SHORT

You are paying Ken Collins Marketing (via Shop Talk with Ken) $5 every month to add your name to the list of supporters on our Shop Talk with Ken website and to the end credits of every Shop Talk with Ken episode between the time you make your first payment and the time you cancel your support (should that day ever come).

Website Addition

In some cases, this can happen within a day.  In some cases, your name will appear on the site within a week.  Regardless, we appreciate your support and will get your name on the site as soon as we possibly can.  If you should decide to cancel your support, we will remove your name from the site as soon as we possibly can.

End Credit Addition

In some cases, we will get your name added to the end credits of the next episode.  In other cases, depending on the timeframe, we may miss the first episode after you make your first payment – but we will get into the first episode we possibly can.  If you should decide to cancel your support, we will remove your name from the credits as soon as we possibly can, but we may miss an episode depending on the timeframe of your cancellation.

 

DRINK IT UP

IN SHORT

You are paying Ken Collins Marketing (via Shop Talk with Ken) $10 every month to add your name to the list of supporters on our Shop Talk with Ken website – and – to the end credits of every Shop Talk with Ken episode between the time you make your first payment and the time you cancel your support (should that day ever come) – and – to receive a Shop Talk with Ken coffee mug (but you can drink other things from it too).

Website Addition

In some cases, this can happen within a day.  In some cases, your name will appear on the site within a week.  Regardless, we appreciate your support and will get your name on the site as soon as we possibly can.  If you should decide to cancel your support, we will remove your name from the site as soon as we possibly can.

Coffee Mug

Ken Collins may need to contact you via phone or email to learn where we need to send your new coffee mug.  Depending on your location (and other factors) Ken may personally deliver your mug – or we may ship it to you in the mail.  Regardless, we appreciate your support and will get your mug to you as soon as we possibly can.  If we run low on our coffee mug inventory and have to order more mugs, we will expedite the process as much as we can to get your mug to you as soon as we can.

 

SHOUT IT OUT

IN SHORT

You are paying Ken Collins Marketing (via Shop Talk with Ken) $20 every month to add your name to the list of supporters on our Shop Talk with Ken website – and – to the end credits of every Shop Talk with Ken episode between the time you make your first payment and the time you cancel your support (should that day ever come) – and – to receive a Shop Talk with Ken coffee mug (but you can drink other things from it too) – and to receive a Shop Talk with Ken t-shirt.

Ken Collins will need to contact you via phone or email to learn your shirt size and where to send your new t-shirt.  Depending on your location (and other factors) Ken may personally deliver your shirt – or we may ship it to you in the mail.  Regardless, we appreciate your support and will get your shirt to you as soon as we possibly can.  If we run low on our t-shirt inventory and have to order more in your size, we will expedite the process as much as we can to get your shirt to you as soon as we can.
